<span style="letter-spacing:1px;">任静表示,根据《民法典》,“住改商”应满足两个条件。第一个条件中,业主或物业使用人通常可以通过获得行政审批,同时遵守物业管理规约的方式得以满足,但是管理规约中对住宅改为经营性用房有禁止性规定的,不得将住宅改为经营性用房。第二个条件中,“有利害关系的业主”其范围包括法定的有利害关系业主和需举证证明的有利害关系业主。前者指“住改商”物业所在楼栋的其他业主,后者指建筑区划内、“住改商”物业所在楼栋以外的业主。后者须举证证明本人与“住改商”房屋有利害关系,该利害关系可以是已经发生的损害,也可以是潜在的损害。</span>
