15px;">为保障人民群众生命财产安全，根据《中华人民共和国大气污染防治法》《烟花爆竹安全管理条例》等有关法律、法规精神，结合我县实际，现就有关事宜通告如下：</span></p><p style="line-height: 2em;text-indent: 2em;"><br/></p><p style="line-height: 2em;text-indent: 2em;"><strong><span style="letter-spacing: 2px;font-size: 15px;">一、烟花爆竹禁限放区域</span></strong></p><section style="line-height: 2em;text-indent: 2em;margin-top: 8px;"><strong><span style="letter-spacing: 2px;font-size: 15px;">（一）禁放区域：</span></strong><span style="letter-spacing: 2px;font-size: 15px;">南台街道、晋城街道、常林镇全域，多扶镇场镇及鹭鸶沟村、西山井村、老林沟村、莲池镇场镇及田家坝村、占山乡莲花穴村、凤鸣镇场镇。</span></section><section style="line-height: 2em;text-indent: 2em;margin-top: 8px;"><strong><span style="letter-spacing: 2px;font-size: 15px;">（二）限放区域：</span></strong><span style="letter-spacing: 2px;font-size: 15px;">除禁放区域外的其他区域均为限放区域。</span><span style="letter-spacing: 2px;font-size: 15px;"></span></section><p style="line-height: 2em;text-indent: 2em;"><br/></p><p style="line-height: 2em;text-indent: 2em;"><strong><span style="letter-spacing: 2px;font-size: 15px;">二、禁放时间</span></strong></p><section style="line-height: 2em;text-indent: 2em;margin-top: 8px;"><span style="letter-spacing: 2px;font-size: 15px;">（一）禁放区域全年禁止燃放烟花爆竹。</span></section><section style="line-height: 2em;text-indent: 2em;margin-top: 8px;"><span style="letter-spacing: 2px;font-size: 15px;">（二）限放区域燃放时间仅限于农历除夕、正月初一至初六、正月十五，共计8天，其余时间禁止燃放烟花爆竹。</span></section><section style="line-height: 2em;text-indent: 2em;margin-top: 8px;"><span style="letter-spacing: 2px;font-size: 15px;">（三）如遇重污染天气Ⅱ级及以上预警时，全域禁止一切燃放烟花爆竹行为。在本县禁放区域内举行重大庆典活动，需要燃放烟花爆竹的，应当报县人民政府审批。</span></section><p style="line-height: 2em;text-indent: 2em;"><br/></p><p style="line-height: 2em;text-indent: 2em;"><strong><span style="letter-spacing: 2px;font-size: 15px;">三、未列入禁放区域，禁止在下列地点燃放烟花爆竹：</span></strong></p><section style="line-height: 2em;text-indent: 2em;margin-top: 8px;"><span style="letter-spacing: 2px;font-size: 15px;">（一）广场、市场、宗教场所、殡葬服务场所、景区、公园、商场、超市、大型文体活动场所、休闲娱乐场所、党政机关等人员密集的公共场所；</span></section><section style="line-height: 2em;text-indent: 2em;margin-top: 8px;"><span style="letter-spacing: 2px;font-size: 15px;">（二）医疗机构、幼儿园及中小学校、养老院、图书馆、文物保护单位及其周围区域内；</span></section><section style="line-height: 2em;text-indent: 2em;margin-top: 8px;"><span style="letter-spacing: 2px;font-size: 15px;">（三）车站、停车场以及重要输（变）电设施安全保护区内；</span></section><section style="line-height: 2em;text-indent: 2em;margin-top: 8px;"><span style="letter-spacing: 2px;font-size: 15px;">（四）加油（气）站、烟花爆竹经营（储存）点、民用爆炸物品储存库等生产、存放易燃易爆物品场点以及禁止使用明火的场所及周围区域内；</span></section><section style="line-height: 2em;text-indent: 2em;margin-top: 8px;"><span style="letter-spacing: 2px;font-size: 15px;">（五）山（树）林等重点防火区及周围区域内；</span></section><section style="line-height: 2em;text-indent: 2em;margin-top: 8px;"><span style="letter-spacing: 2px;font-size: 15px;">（六）房屋楼顶、露台、楼梯、走廊、窗口等地点；</span></section><section style="line-height: 2em;text-indent: 2em;margin-top: 8px;"><span style="letter-spacing: 2px;font-size: 2px;font-size: 15px;">四、法律责任</span></strong></p><section style="line-height: 2em;text-indent: 2em;margin-top: 8px;"><span style="letter-spacing: 2px;font-size: 15px;">对违反本通告的单位或个人，由公安机关责令停止燃放，处一百元以上五百元以下罚款；对违反本通告的公职人员，纪委监委依法依纪追究相关人员责任和领导责任；对擅自举办焰火晚会或者其他大型焰火燃放活动的，由公安机关依据《烟花爆竹安全管理条例》责令停止燃放，并对责任单位处一万元以上五万元以下的罚款；对未经许可生产、经营烟花爆竹制品的，由应急管理局依据《烟花爆竹安全管理条例》处一万元以上十万元以下的罚款，并没收非法生产、经营的物品及违法所得；对违反治安管理的，由公安机关依照《治安管理处罚法》规定予以处罚；涉嫌犯罪的，依法移送司法机关处理；造成损害的，依法承担赔偿责任。</span></section><p 2px;">为加强烟花爆竹燃放管理，防治噪声和大气污染，保障人民群众生命财产安全和身心健康，根据《中华人民共和国大气污染防治法》《中华人民共和国治安管理处罚法》《烟花爆竹安全管理条例》等有关法律法规，现将我县禁止燃放烟花爆竹有关规定通告如下：</span></p><p style="line-height: 2em;text-indent: 2em;"><br/></p><p 2px;">一、<strong>仪陇县城城区及新政镇、度门街道、柴井乡全域为禁放区，全年禁止燃放烟花爆竹；禁放区以外的乡镇为限放区，限放区在春节、元宵节以及重污染天气预警期间限制燃放烟花爆竹。</strong></span></p><p style="line-height: 2em;text-indent: 2em;"><br/></p><p style="line-height: 2em;text-indent: 2em;"><span style="font-size: 15px;letter-spacing: 2px;">二、任何单位、团体、组织和个人应严格遵守《通告》规定，公安、应急管理、综合行政执法、生态环境等部门和禁放区所属乡镇（街道）做好禁止燃放烟花爆竹的宣传和管控工作。限放区的属地乡镇人民政府结合本地实际，联合当地派出所等单位加强本辖区限制燃放烟花爆竹的宣传和管控工作。</span></p><p style="line-height: 2em;text-indent: 2em;"><br/></p><p style="line-height: 2em;text-indent: 2em;"><span style="font-size: 15px;letter-spacing: 2px;">三、对未经许可举办焰火晚会以及其他大型焰火燃放活动的，依据《烟花爆竹安全管理条例》四十二条第一款之规定，由公安部门责令停止燃放，对责任单位处1万元以上5万元以下的罚款。在禁止燃放烟花爆竹的时间、地点燃放烟花爆竹的，依据《烟花爆竹安全管理条例》四十二条第二款之规定，由公安部门责令停止燃放，处100元以上500元以下的罚款；构成违反治安管理行为的，依法给予治安管理处罚。</span></p><p style="line-height: 2em;text-indent: 2em;"><br/></p><p style="line-height: 2em;text-indent: 2em;"><span style="font-size: 15px;letter-spacing: 2px;">四、未经许可经营烟花爆竹制品的，依据《烟花爆竹安全管理条例》第三十六条之规定，由安全生产监督管理部门责令停止非法经营活动，处2万元以上10万元以下的罚款，并没收非法经营的物品及违法所得。非法经营、运输烟花爆竹，构成违反治安管理行为的，依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。</span></p><p style="line-height: 2em;text-indent: style="letter-spacing: 2px;font-size: 15px;">按照《烟花爆竹安全管理条例》第四十二条之规定，在禁止燃放烟花爆竹的时间、地点燃放烟花爆竹的，由公安部门责令停止燃放，处100元以上500元以下罚款；构成违反治安管理行为的，依法给予治安管理处罚。 </span></p><p style="line-height: 2em;text-indent: 2px;">（一）相如街道檬子垭、相如山、龙滩桥、团包岭、油房沟、凤仙寨、火车站、龙岗寨、土祖庙、三星桥、真武山、罐子坝、塔子山、回龙沟、玉龙山、城南桥、凤凰山、铧厂等村（社区）区域，周口街道龙角山、磨子西街、磨子东街、下河街、茅店子、建设南路、木桥沟、笔架山、东风路、青龙街、三湾堰等社区区域，锦屏镇、河舒镇场镇以及河舒工业园区。</span></section><section
