没有预售许可证就卖房,开发商应承担哪些行政责任?

font-size: medium; letter-spacing: 0.544px; white-space: normal;">&nbsp; &nbsp;根据《城市商品房预售管理办法》的规定,开发商未取得《商品房预售许可证》预售商品房的,依照《城市房地产开发经营管理条例》第三十九条的规定处罚,即擅自预售商品房的,由县级以上人民政府房地产开发主管部门责令停止违法行为,没收违法所得,可以并处已收取的预付款1%以下的罚款。可见,房地产开发主管部门对开发商违反商品房预售规定,未取得《商品房预售许可证》预售商品房的行为有三种处罚方式:</p><p class="" style="color: rgb(51, 51, 51); font-size: medium; letter-spacing: 0.544px; white-space: normal;">&nbsp; &nbsp;3.罚款,罚款是房地产管理部门依法强制违法预售商品房的开发商在一定期限内向国家缴纳一定数额的金钱的处罚方式。罚款的数额幅度有着最高的限制,即不超过开发商违法预售商品房收取的预付款的1%。</p><p class="" style="color: rgb(51, 51, 51); font-size: medium; letter-spacing: 0.544px; white-space: normal;">&nbsp; &nbsp;根据《城市商品房预售管理办法》的规定,开发企业隐瞒有关情况、提供虚假材料,或者采用欺编、贿赂等不正当手段取得商品房预售许可的,由房地产管理部门责令停止预售,撤销商品房预售许可,并处3万元罚款。根据该条规定,开发商以不正手段取得《商品房预售许可证》的手段包括:隐瞒有关情况、提供虚假材料、欺骗、贿赂等等。其处罚方式有三种:</p><p class="" style="color: rgb(51, 51, 51); font-size: medium; letter-spacing: 0.544px; white-space: normal;">&nbsp; &nbsp;1.责令停止预售,撤销商品房预售许可;这一规定同样不是直接限制或剥夺开发商的财产权,而是责令其暂时停止其所从事的预售商品房活动,只要开发商在一定期限内及时纠正了违法行为,通过合法途径再次取得了《商品房预售许可证》,就仍然可以继续从事被停止的预售商品房活动。</p><p class="" style="color: rgb(51, 51, 51); font-size: medium; letter-spacing: 0.544px; white-space: normal;">&nbsp; &nbsp;此外,《行政处罚法》对以上行政处罚决定的作出有严格的规定。责令停产停业、吊销许可证或者执照以及较大数额的罚款等行政处罚决定作出之前,当事人有要求举行听证的权利。房地产开发商对房地产管理部门作出的行政处罚决定不服的,可以依法申请行政复议或者提起行政诉讼,要求改变或者撤销行政单位的行政处罚决定,维护开发商的合法权益。</p><p><br/></p>
